By downloading, installing, or using the Migraine Weather app (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
2. Description of Service
Migraine Weather provides weather-based migraine risk forecasts designed to help migraine sufferers anticipate and prepare for weather-triggered migraines. Our Service includes:
- Real-time migraine risk assessment based on barometric pressure, temperature, and humidity changes
- Multi-day forecasts showing upcoming risk levels
- Push notifications for approaching high-risk weather conditions
- Optional SMS alerts for high-risk conditions
- Migraine logging stored locally on your device
- A 30-day free trial followed by a paid subscription (Monthly: $3.99/month, Annual: $39.99/year)
3. User Accounts
You do not need to create an account or provide any personal information to use Migraine Weather. The app generates a random device identifier stored securely on your device. Your location is used solely to provide local weather forecasts and is rounded to approximately 7.5 kilometers for privacy.
4. Accuracy of Information
While we strive to provide accurate weather information and migraine risk predictions, Migraine Weather relies on third-party weather data and statistical models. We cannot guarantee the accuracy, completeness, or timeliness of risk predictions.
Important: The Service is not a medical device and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider about your migraines and treatment options.
5. Payments and Subscriptions
Migraine Weather offers a 30-day free trial. After the trial, a subscription is required to continue using the Service:
- Monthly subscription: $3.99/month
- Annual subscription: $39.99/year
All payments are processed through Apple's App Store. These transactions are subject to Apple's terms and conditions. You may cancel your subscription at any time through your Apple ID settings.
6. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, and software, are owned by Migraine Weather and are protected by United States and international copyright, trademark, and other intellectual property laws.
7. Limitation of Liability
To the maximum extent permitted by law, Migraine Weather shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the Service
- Any inaccuracies or delays in weather predictions or risk assessments
- Any actions you take or fail to take based on information provided by the Service
- Any health outcomes related to your reliance on our Service
The Service is provided for informational purposes only and is not intended to replace professional medical advice.
8. Indemnification
You agree to defend, indemnify, and hold harmless Migraine Weather, its employees, contractors, and service providers from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Service.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
